THESE TERMS CONTAIN A BINDING ARBITRATION PROVISION AND CLASS ACTION WAIVER (SEE SECTION 17). EXCEPT FOR CERTAIN TYPES OF DISPUTES DESCRIBED IN SECTION 17 BELOW OR WHERE PROHIBITED BY APPLICABLE LAW (INCLUDING ILLINOIS BIPA), YOU AGREE THAT DISPUTES BETWEEN YOU AND GRACEMEET WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
YOU MAY OPT OUT OF ARBITRATION WITHIN 30 DAYS OF FIRST ACCEPTING THESE TERMS — SEE SECTION 17.7.
You may cancel your subscription, without penalty or obligation, at any time prior to midnight of the third business day following the date you subscribed. If you subscribed using an Apple ID, refunds are handled by Apple. If you subscribed via Google Play, refunds are handled by Google. If you subscribed directly, mail a notice to: Nutty Face s.r.o., Hainemannova 2695/6, Dejvice, 160 00 Prague, Czechia.
See Section 15 for your specific rights under EU consumer law, the Digital Services Act (DSA), the right of withdrawal, and EU dispute resolution mechanisms. Mandatory consumer protection rights of your country of residence cannot be waived by these Terms.
1. ACCEPTANCE OF TERMS
This Terms of Use Agreement ("Agreement") constitutes a legally binding agreement made between you ("you") and Nutty Face s.r.o. ("GraceMeet", "we", "us", or "our"), a limited liability company (společnost s ručením omezeným) organized under the laws of the Czech Republic, with registered office at Hainemannova 2695/6, Dejvice, 160 00 Prague, Czechia, Company ID (IČO): 03169901, Tax ID (DIČ): CZ03169901.
By creating an account, downloading the mobile application, or accessing the Service, you acknowledge that you have read, understood, and agree to be bound by this Agreement, our Privacy Policy, and our Community Guidelines, which are incorporated herein by reference. IF YOU DO NOT AGREE TO BE BOUND BY ALL OF THESE TERMS, DO NOT USE THE SERVICE.
2. ELIGIBILITY & REPRESENTATIONS
You are not authorized to create an account or access the Service unless ALL of the following are true:
- Age: You are at least 18 years of age. For users in jurisdictions with a higher age of majority for adult-oriented services, you must meet that higher age requirement.
- Faith Acknowledgment: You acknowledge that GraceMeet is a Christian dating service. Faith-related profile fields (denomination, church attendance, core values) are optional but central to the matching experience. We process your religious affiliation only when you actively enter it through the in-app profile screens. By entering and saving this information, you provide your explicit consent to its processing for faith-based matching. You can edit or remove faith information at any time in Settings.
- Capacity: You can form a binding contract with GraceMeet under the laws of your jurisdiction.
- Single Account: You have not previously been banned, suspended, or had your account terminated by GraceMeet for Terms violations. Creating multiple accounts or evading bans is a material breach.
- Sanctions Compliance: You are not a person barred from using the Service under sanctions laws of the United States (including OFAC), the European Union, the United Kingdom, or any other applicable jurisdiction.
- Sex Offender Representation: You represent and warrant that:
- You are NOT required to register as a sex offender in any state, federal, local, or foreign sex offender registry
- You have NOT been convicted of any felony involving sexual violence or sexual exploitation
- You have NOT been convicted of any crime involving a minor
- You have NOT been convicted of stalking, harassment, or domestic violence within the past 5 years
- Truthful Information: You will provide accurate, current, and complete information during registration and profile creation, including your real photos, age, and identity information.
- Harmful Conduct: We reserve the right to remove your account if we find credible evidence or receive valid reports indicating a violation of these representations or other harmful conduct, even if no conviction exists.
3. ACCOUNT & SECURITY
You are responsible for maintaining the confidentiality of your login credentials. You are solely responsible for all activities that occur under your account. If you believe your account has been compromised, contact us immediately at support@gracemeet.com.
We may use automated systems and third-party technologies (including Firebase App Check, AWS Rekognition liveness detection, and behavioral fraud detection) to detect suspicious activity. We reserve the right to block, suspend, or terminate your account without notice and without refund if we reasonably believe you have violated this Agreement. You may appeal any moderation decision via the procedures described in Section 15.4 (EU users) or directly via support@gracemeet.com.
3.1 Account Restrictions and Appeals
When we restrict, suspend, or terminate your account, we will:
- Display a clear statement of reasons in the App. When you next open the App, the restricted-account screen will show the category of violation and reference the relevant Terms section. This statement persists so you can revisit it at any time while your account is restricted.
- Provide an appeal mechanism. You may appeal by emailing support@gracemeet.com with your account email and a brief explanation of why you believe the restriction is incorrect.
- 30-day appeal window. Appeals must be filed within 30 days of the restriction taking effect.
- 14-day response target. We aim to review and respond to appeals within 14 days of receipt.
- Human review of automated decisions. Where the restriction was based on automated detection (AI content classifiers, fraud signals, behavioral patterns), your appeal is reviewed by a human moderator, in line with EU DSA Article 17 and GDPR Article 22.
- Right to judicial redress. In addition to this internal appeal process, you retain your right to seek judicial redress before the competent court in accordance with Section 18 (Governing Law). For EU/EEA/UK consumers this right cannot be waived.
Exception — Law Enforcement Investigations. Where disclosing specific reasons would interfere with a law enforcement investigation — for example, where we have made a report under DSA Article 18 or 18 U.S.C. § 2258A (NCMEC CyberTipline) — we may withhold the specific factual basis of the restriction until the investigation permits disclosure, as permitted under applicable law (including DSA Article 17(3)).
For the full DSA Article 17 Statement of Reasons framework, see Section 15.4 below.
4. COMMUNITY RULES & PROHIBITED CONDUCT
You agree NOT to use the Service for the following:
4.1 Illegal or Harmful Conduct
- Any illegal purpose or violation of applicable law
- Soliciting money, fundraising, or commercial promotion
- Phishing, fraud, or financial scams (including romance scams)

4.3 Child Safety (CRITICAL)

- National law enforcement and child safety authorities in the user's country of residence

- Multiple accounts or ban evasion
- Manipulating reviews, ratings, or matching algorithms
- Reverse engineering, decompiling, or attempting to extract source code
- Circumventing rate limits or security measures
4.6 Faith-Based Matching Acknowledgment
GraceMeet's nature as a Christian dating service involves matching users based on shared religious values. This is not unlawful discrimination — it is the express, transparent purpose of the Service. Users may set preferences for matching based on religious denomination consistent with the Service's Christian focus. The Service is open to all users 18+ regardless of background, but the matching algorithm prioritizes shared faith values.
5. RIGHTS YOU GRANT GRACEMEET
a. License to Content: By creating an account and uploading Content (photos, profile information, messages, reports), you grant to GraceMeet a worldwide, transferable, sub-licensable, royalty-free license to host, store, use, copy, display, reproduce, adapt, edit, publish, modify, and distribute your Content for the purpose of providing and improving the Service.
b. AI & Algorithmic Improvements: We do NOT use your private messages, photos, or faith-related profile information to train AI models. We may use de-identified or aggregated operational data (such as anonymous usage patterns and content moderation outcomes) to improve safety, spam prevention, and matching quality where permitted by law. If we ever expand AI training to include your individual content, we will obtain your separate opt-in consent.
c. Automated Decision Making: We may use automated systems, including AI-based classifiers (AWS Rekognition, internal models), to detect spam, fraud, unsafe content, sexually explicit imagery, suspected CSAM, and bot accounts. Significant automated decisions affecting your account are reviewed by humans on appeal, in compliance with EU DSA Article 17 and GDPR Article 22.
6. PURCHASES, SUBSCRIPTIONS & VIRTUAL ITEMS
a. Auto-Renewal: If you purchase a subscription via an External Service (Apple App Store / Google Play), it will renew automatically at the then-current price unless cancelled at least 24 hours before the end of the current period. Manage subscriptions:
- iOS: Settings → [Your Name] → Subscriptions
- Android: Google Play Store → Profile → Payments & subscriptions → Subscriptions
b. California Auto-Renewal Disclosure (SB 313): California subscribers will receive renewal notices and have access to cancellation methods consistent with California Business and Professions Code §17602.
c. Virtual Items: You may purchase a limited, personal, non-transferable, revocable license to use "Virtual Items" (e.g., Coins, Boosts). VIRTUAL ITEMS ARE NOT REAL CURRENCY, DO NOT EARN INTEREST, AND ARE NOT REFUNDABLE EXCEPT WHERE REQUIRED BY APPLICABLE LAW.
d. Refunds: All charges are nonrefundable except where required by applicable law (including applicable EU/EEA withdrawal rights described in Section 15.1) or by the applicable app store's policies. For Apple subscriptions, request refunds via reportaproblem.apple.com. For Google Play, request via the Play Store.
e. Price Changes: We may change subscription prices. Material price increases will be communicated in advance, and you may cancel before the new price takes effect.
7. ACCOUNT DELETION
Apple App Store Compliance (Guideline 5.1.1(v)) & Google Play Compliance: You may delete your account directly in the App at Settings → Account → Delete account, or via our website at gracemeet.com/delete_account.html.
What happens upon deletion:
- Profile, photos, and matches deleted within 30 days
- Messages deleted from Firebase Realtime Database within 30 days
- Biometric data permanently destroyed within 30 days
- Backend identifier-only retention for ban evasion prevention (limited fields, banned accounts only)
- Payment transaction records retained for 10 years (tax/accounting compliance, maintained outside app systems)
- Account deletion is irreversible
Alternative deletion methods:
- Email: support@gracemeet.com
- Privacy request: support@gracemeet.com
8. PUSH NOTIFICATIONS & LOCATION SERVICES
a. Location: If you authorize the App to access your location, we collect and process your precise GPS coordinates to provide location-based matching features. You can revoke location permission in your device settings, but matching functionality requires location.
b. Notifications: We may send you push notifications for matches, messages, and service updates. You can opt-out in device settings or in-app notification preferences.
9. SAFETY DISCLAIMER (CRITICAL)
YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER MEMBERS. YOU UNDERSTAND THAT GRACEMEET DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS ON ITS MEMBERS. GRACEMEET MAKES NO REPRESENTATIONS OR WARRANTIES AS TO THE CONDUCT OF MEMBERS.
GRACEMEET RESERVES THE RIGHT TO CONDUCT SCREENINGS AT ANY TIME USING AVAILABLE PUBLIC RECORDS. YOU AGREE THAT GRACEMEET SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER ARISING OUT OF YOUR INTERACTIONS WITH OTHER USERS, EXCEPT WHERE PROHIBITED BY APPLICABLE LAW (INCLUDING MANDATORY CONSUMER PROTECTION).
Safety Resources: See our Child Safety page and Privacy Policy Section 16 for safety hotlines and reporting channels.
10. BIOMETRIC DATA (BIPA / TEXAS CUBI / WASHINGTON)
If you use our optional Selfie Verification feature, GraceMeet (through its service provider Amazon Web Services) uses Face Liveness to confirm a live person is present (anti-spoof detection).
What happens during verification:
- You record a short video selfie (typically 5-10 seconds)
- AWS Rekognition Face Liveness analyzes the video to distinguish a real human from a photo, video replay, or deepfake
- AWS returns a liveness confidence score (numeric value 0-100), which we store with your verification record
- A reference image from the session is stored for fraud review
What we do NOT do:
- We do NOT extract or store persistent face geometry templates or biometric vectors
- We do NOT compare your face against other users, your own profile photos, or any face database
- We do NOT use Selfie Verification for identification beyond confirming a live human at sign-up
Specific Disclosures (BIPA-compliant per 740 ILCS 14):
- Type of processing: AWS Rekognition Face Liveness analyzes short video frames internally to detect spoofing. AWS does not return persistent face geometry vectors to us; we receive only a numeric confidence score plus a reference image.
- Purpose: Solely fraud prevention — blocking fake accounts, bots, and spoof attempts at sign-up. We do NOT use this data for advertising, marketing, profiling, identification, or any commercial purpose unrelated to fraud prevention.
- Storage: Reference image stored in encrypted Amazon S3 (US-East-1, Northern Virginia) at
verify_selfie_photos/{userId}/{sessionId}/. Liveness confidence score stored in our database (US-East-1). - Disclosure to Third Parties: We share Selfie Verification data ONLY with Amazon Web Services (the service provider performing the liveness check) and with law enforcement only under valid subpoena, court order, or imminent safety emergency. We do NOT sell, lease, trade, or otherwise profit from this data. We do NOT share with Meta, Google, advertisers, data brokers, or others.
- Retention Schedule: The reference image, liveness score, and verification record are retained until (i) you request deletion via email, (ii) one (1) year from your last interaction with the Service, or (iii) account deletion (whichever occurs first). Upon account deletion, all Selfie Verification data is permanently destroyed within 30 days.
- Written Consent: By tapping "Verify my profile," you provide your written, informed consent under the Illinois Biometric Information Privacy Act (BIPA, 740 ILCS 14), the Texas Capture or Use of Biometric Identifier Act (CUBI, Tex. Bus. & Com. Code §503.001), and Washington's biometric privacy law. Although we do not store persistent biometric templates, AWS Face Liveness internally analyzes face geometry during the liveness check, which is treated as biometric processing under these statutes.
- Right to Deletion: You may request immediate deletion of Selfie Verification data without affecting your account by emailing support@gracemeet.com with subject "Delete Selfie Verification Data".
Sensitive Data (US State Laws): Some information processed by GraceMeet may be considered "Sensitive Data" or "Sensitive Personal Information" under US state laws (including California, Colorado, Virginia, Connecticut, Texas, Washington). We process this information only when you actively provide it through the in-app profile screens. The act of entering and saving this information serves as your explicit consent to its processing for the purposes described in our Privacy Policy. You can edit or remove this information at any time in Settings.
11. DISCLAIMER OF WARRANTIES
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. GRACEMEET EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
GRACEMEET MAKES NO REPRESENTATIONS REGARDING THE TRUTH OR ACCURACY OF MEMBER PROFILES OR THE CHARACTER OF MEMBERS.
12. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, GRACEMEET'S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID, IF ANY, BY YOU TO GRACEMEET DURING THE TWENTY-FOUR (24) MONTH PERIOD IMMEDIATELY PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.
Mandatory Consumer Protection Exception: Nothing in these Terms limits liability where such limitation is prohibited by applicable law, including:
- Mandatory consumer protection laws of the EU/EEA/UK
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Liability that cannot be excluded under applicable law
13. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless GraceMeet, its affiliates, officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service
- Your Content or interactions with other members
- Your violation of this Agreement or applicable law
- Your violation of any third-party rights
This indemnification does not apply where prohibited by mandatory consumer protection law.
14. APP STORE TERMS
This Agreement is between you and GraceMeet, not Apple Inc. or Google LLC. Apple and Google are third-party beneficiaries of this Agreement and may enforce its terms against you.
Apple-Specific: If you use the iOS App, you acknowledge that Apple has no obligation to provide maintenance and support services. Apple is not responsible for any product warranties (express or implied) and is not responsible for addressing claims relating to the App.
Google-Specific: If you use the Android App, the Service is provided by GraceMeet, not by Google. Google is not responsible for the Service.
15. EU/EEA/UK USER RIGHTS
15.1 Right of Withdrawal (14 days)
EU/EEA consumers have a 14-day right of withdrawal under the Consumer Rights Directive (2011/83/EU) for paid subscriptions.
GraceMeet subscriptions are purchased exclusively through Apple App Store or Google Play and follow each platform's standard subscription flow per Apple's App Store Review Guidelines and Google Play Developer Policy. Pre-purchase disclosures (price, billing period, auto-renewal terms) are presented by Apple or Google at the moment of purchase.
Refunds and cancellations are handled directly by the platform from which you subscribed:
- Apple App Store: request a refund at reportaproblem.apple.com
- Google Play: through the Play Store under Profile → Payments & subscriptions → Subscriptions
If you need help exercising your EU/EEA right of withdrawal within 14 days of subscription, contact support@gracemeet.com with subject "EU Withdrawal Request" and we will assist you with the platform refund process.
Note: GraceMeet does not separately collect a waiver of the right of withdrawal in the App. Your 14-day right of withdrawal applies to the extent required by EU law, subject to any waiver collected by Apple or Google through their standard subscription flow.
15.2 Mandatory Consumer Protection
Nothing in these Terms limits your mandatory consumer protection rights under EU law or the law of your habitual residence in the EEA/UK. In case of conflict, mandatory consumer law prevails.
15.3 Czech Consumer Protection
For users in the Czech Republic, the Czech consumer protection authority is Česká obchodní inspekce (www.coi.cz).
15.4 Digital Services Act (DSA) Compliance
Per Regulation (EU) 2022/2065:
- SME Status (Article 19): GraceMeet currently qualifies as a micro/small enterprise. Articles 20-24 (internal complaint-handling, out-of-court dispute settlement, trusted flaggers, measures against misuse, additional online-platform transparency reporting) do not apply to us at this scale. We will adopt those obligations if our scale exceeds the threshold.
- DSA Single Point of Contact (Article 11): support@gracemeet.com (English)
- Reporting Illegal Content (Article 16): Use the in-app reporting tool or email support@gracemeet.com
- Statement of Reasons (Article 17): When we restrict your account or remove content, we provide a statement of reasons including the decision, basis, whether automated means were used, and how to contact us about the decision
- Reporting Criminal Offences (Article 18): We report serious criminal offences threatening life or safety to the relevant law enforcement authority
For full DSA disclosures see our Privacy Policy Section 12.
15.5 EU AI Act
Per Regulation (EU) 2024/1689 (EU AI Act), we provide transparency about our automated recommendation and content moderation systems. Our content moderation includes human oversight for decisions that significantly affect your account. We do NOT use prohibited AI practices such as social scoring, emotion recognition, or biometric categorization based on sensitive attributes (beyond face liveness for fraud prevention).
See Privacy Policy Section 5 for full AI disclosures and your right to human review under GDPR Article 22.
16. ARTIFICIAL INTELLIGENCE AND AUTOMATED PROCESSING
GraceMeet uses AI and automated processing for:
16.1 Matching
An algorithm suggests profiles based on shared interests, location, denomination, age preferences, and core values. You can swipe on any user shown — the algorithm only orders suggestions, it does not restrict your choices.
16.2 Content Moderation
AI classifiers detect:
- Nudity and sexually explicit images (image classifiers)
- Spam, scam, and harassment patterns (text classifiers)
- Suspected CSAM (matched against NCMEC hash database)
- Bot accounts and fake profiles (behavioral patterns)
Significant moderation decisions (account ban, removal of all content) include human review on appeal.
16.3 Fraud Detection
Automated detection of suspicious account activity, payment fraud, and ban evasion. Triggered actions are appealable through human review.
16.4 Liveness Detection
AWS Rekognition AI confirms the selfie video shows a live person (not a static photo or video replay) for the optional Selfie Verification feature.
16.5 Right to Human Review (EU)
EU users have the right under GDPR Article 22 to not be subject to solely automated decisions producing legal or similarly significant effects. Request human review at support@gracemeet.com.
16.6 Prohibited AI Practices
We do NOT use AI for: social scoring, emotion recognition, biometric categorization based on sensitive attributes (beyond face liveness for fraud prevention), subliminal manipulation, or other practices prohibited under the EU AI Act.
17. DISPUTE RESOLUTION: ARBITRATION & CLASS ACTION WAIVER (U.S.)
17.1 Mandatory Informal Resolution
Before initiating arbitration, you agree to first contact us at support@gracemeet.com with a written description of your dispute including your name, account email/phone, factual description, and relief sought. The parties agree to negotiate in good faith for at least 60 days before commencing arbitration.
17.2 Binding Arbitration (US Users)
Except as provided in 17.4 and 17.5, all disputes shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration may be conducted in the county where you reside (or remotely if both parties agree). We will pay or reimburse filing and arbitration fees for non-frivolous claims up to the amount permitted by AAA rules.
17.3 Class Action Waiver
YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT, COLLECTIVE ACTION, OR CLASS-WIDE ARBITRATION. ALL DISPUTES WILL BE ARBITRATED INDIVIDUALLY.
17.4 Exceptions to Arbitration
Either party may bring action in court for:
- Individual claims in small claims court (under jurisdictional limit)
- Injunctive or equitable relief for intellectual property infringement
- Disputes regarding unauthorized access to the Service
- Where arbitration is prohibited by applicable law
17.5 Illinois BIPA Class Action Notice
Illinois Residents: The arbitration agreement and class action waiver in this Section do NOT apply to claims under the Illinois Biometric Information Privacy Act (BIPA, 740 ILCS 14) where Illinois law prohibits arbitration or class action waivers of such claims. BIPA claims may be brought in Illinois courts on a class basis where permitted by law.
17.6 Mass Arbitration Procedures
If 25 or more similar arbitration claims are initiated against GraceMeet within a 60-day period, both parties agree to AAA's mass arbitration procedures, which may include batched arbitrations and bellwether procedures.
17.7 30-Day Opt-Out Right
You may opt out of this arbitration agreement and class action waiver within 30 days of first accepting these Terms by emailing support@gracemeet.com with:
- Your name
- Your account email or phone number
- Clear statement: "I opt out of the arbitration agreement and class action waiver"
Opting out does not affect any other provision of this Agreement.
18. GOVERNING LAW & VENUE
18.1 US Users
For US users, this Agreement is governed by the Federal Arbitration Act and the laws of the State of Delaware, without regard to conflict-of-laws principles. Subject to the arbitration provisions in Section 17, any judicial proceedings shall be brought exclusively in the federal or state courts of Delaware.
18.2 EU/EEA/UK Users
For users in the EU, EEA, or UK, this Agreement is governed by the laws of the Czech Republic, without prejudice to the mandatory consumer protection rights of your country of habitual residence which cannot be waived. EU/EEA/UK consumers may bring claims in Czech courts OR in the courts of their country of habitual residence.
